Membership Agreement and Membership Details
Initial Term. My initial membership period will last for 12 months, subject to the month-to-month auto-renewal policy described.
I have elected to pay for my dues on a monthly basis. My monthly dues, plus any applicable taxes and fees will be due each month throughout the term of my membership, with my first payment due on the start date and subsequent monthly payments due on the same day of each month thereafter.
By signing below, I authorize ENSELE to charge my account specified below. I agree that the monthly membership dues and renewal fees will be charged on the same day of each month (or the next business day), I understand that ENSELE studio may continue to charge my account or terminate the membership in accordance with the terms and conditions of this Membership Agreement.
My membership is auto-renewable. Following the initial 12-month term, my membership will automatically continue on a month-to-month basis at then-current membership rate until my membership is cancelled by delivering a written cancellation notice to ENSELE at which my membership was purchased. Each ENSELE location location is independently owned and operated, so cancellation policies may vary from location to location, provided that all locations require written notice of cancellation.
My membership will entitle me to receive a specified number of “service credits” as outlined above. I may use my service credits at any time during the initial and renewal term of the Membership Agreement as long as my membership is still in effect and is paid current, but I may not combine service credits to pay for full services. Upon termination or cancellation of my membership, I will have 180 days from the date of cancellation/termination to use all available service credits. When this 180-day period expires, my unredeemed service credits will also expire.
I may cancel an appointment with no charge any time before the close of business on the business day preceding my appointment date. Same-day cancellations will be charged 50% of the scheduled service price. If I do not call to cancel or do not show up for my appointment, I will be charged the full price for the scheduled service. All same day cancellation fees and no-show fees will be automatically charged to my method of payment on file.
My membership is valid at all ENSELE locations, except that reciprocal benefits may vary from location to location. A $20 up-charge may be imposed if I am receiving a service in a location wherein the region charges higher prices based on the costs of doing business in that region, and an up-charge may be imposed based on the tenure and or experience level of the therapist providing my services. I acknowledge that I should review the pricing of the location I am visiting. I also acknowledge and understand that each of the locations are businesses owned and operated by independent business owners which have been granted licenses to use the “ENSELE” name.
For purposes of identification and billing, I agree to provide you with current, accurate, complete and updated information, including my name, address, telephone number and applicable payment data. I agree to promptly notify you of any changes in my membership data (and my purchaser data, if the purchaser and member are different), and I agree to reimburse you for any out-of-pocket costs you incur if I fail to do so.
You agree to sell, and I agree to purchase, the goods and services described above. I agree to pay you for these goods and services according to the payment schedule shown above. The MEMBERSHIP TERMS AND CONDITIONS attached to this Membership Agreement (SEE the following two pages) are also part of this Membership Agreement and are fully binding on me. I agree to be bound by all of the terms in this membership agreement by signing my name below. All persons signing this Membership Agreement are equally responsible for paying all amounts that become due and payable to ENSELE under this Membership Agreement.
I ACKNOWLEDGE RECEIVING AND READING A COMPLETED COPY OF THIS AGREEMENT (INCLUDING THE FOLLOWING MEMBERSHIP TERMS AND CONDITIONS) BEFORE SIGNING IT:
MEMBERSHIP TERMS AND CONDITIONS
A. My membership includes one refill credit per month, during the term of my membership. My membership will allow me to redeem each last service credit immediately or as I desire throughout the term of my membership. My membership status must be active in order to redeem any other benefits as a member (except that I will have 180 days after cancellation of my membership to use all available unused refill credits.) Except as expressly stated otherwise in this Membership Agreement, my membership services, credits and membership benefits are non- transferable to any other person or entity. My membership is recognized at all ENSELE locations; however, reciprocal benefits can vary from location to location.
Studios are individually owned and operated and may designate their own product return policies. I understand that I need to review pricing of any studio prior to visiting. Picture ID may be required upon enrollment.
B. I agree to follow all rules and regulations established by ENSELE throughout the term of this Membership Agreement. If I violate these rules and regulations, you may at your option, suspend or cancel my membership rights. Purchaser and member will be jointly liable and responsible for payment in full of all unpaid amounts upon any cancellation of this membership. You reserve the right to change the rules ENSELE studio rules and regulations and/or pricing at any time upon reasonable written notice to me.
C. I will have 180 days following cancellation of my membership to use all available unused service refill credits. When this 180-day period expires, my un-redeemed service credits will also expire, unless otherwise specified by applicable state laws and regulations. If required by applicable law, I will be granted additional time to use my remaining service credits. If I have any questions about this, I will contact the studio manager at which my membership originated.
D. If I have paid in full for my initial 12 months of membership services and I die before expiration of the 12 month period, then my membership will be cancelled when you receive written notice of my death, and my estate will be refunded the future unused portion of my membership dues for any credits I have not redeemed. All cancellations and refunds under this section are effective upon the date that the ENSELE studio location at which my membership originated receives the proper documentation. All refunds will be for the months of membership remaining after the effective date of cancellation.
E. You may terminate my membership or deny re-enrollment if have unsatisfactory payment history or if I fail to comply with the rules and regulations established by ENSELE studio. Even if you terminate my membership, you may continue to collect, at any time, any previous outstanding membership balance(s) for any other services that have not been satisfied.
F. ENSELE studio is not responsible for any lost stolen or damaged items.
G. For purposes of identification and billing, I agree to provide you with current, accurate, complete and updated information including my , address, telephone number and applicable payment data. I agree to notify you promptly of any changes to my membership data. I have the right to receive a notice of change in the event that any changes of the terms and conditions of my membership are implemented that will vary the amount to be periodically billed to my account as specified in this Membership Agreement. You will send me a notice of change at the mailing address I have provided at the top of this Membership Agreement at least ten (10) days before the effective date of each change. Except as expressly provided in this Membership Agreement, you may modify your services or the terms and conditions of this Membership Agreement at any time without notice, and those modifications will be effective immediately.
H. Inappropriate behavior by members, other clients, or employees of any Ensele studio businesses will not be tolerated under any circumstances. I recognize that any inappropriate behavior by me may, at your option, result in suspension or cancellation of my membership rights. I agree to notify the ENSELE location’s on-duty manager if I observe or experience any inappropriate behavior.
I. Where required by law, ENSELE business studios employ licensed therapists. If I have any questions, comments or complaints about my therapist, I will bring my concerns to the attention of the manager-on-duty immediately. It is my responsibility to inform the therapist of any pre-existing conditions, allergies, limitations, or specific sensitivities I may have and to inform my therapist if I feel any discomfort while receiving my services. If I have experience any discomfort, I will alert the therapist immediately so that he/she can adjust the application technique as needed.
J. By executing this membership, I agree that ENSELE may contact me from time to time with messages, whether by email, text message or other method regarding my membership account, new services or product offerings and other ENSELE information. I understand that I have the right to opt out of receiving these messages at any time by contacting the studio where I signed my Membership Agreement and asking to be removed from the ENSELE mailing list. My opt-out request will be honored within 10 business days after it is received.
K. I UNDERSTAND AND VOLUNTARILY ACCEPT ANY RISK ASSOCIATED WITH MY SERVICES AND ANY USE OF ENSELE STUDIO FACILITIES, EXCEPT WHERE PROHIBITED BY LAW. I AGREE THAT ENSELE WILL NOT BE LIABLE FOR ANY INJURY, INCLUDING WITHOUT LIMITATION, PERSONAL BODILY OR MENTAL INJURY, ECONOMIC LOSS, OR ANY DAMAGE TO ME RESULTING FROM ANY NEGLIGENT ACTS OR OMISSIONS OF ENSELE, ANYONE ACTING ON ENSELE’S BEHALF OR ANYONE USING THE SERVICES OR THE FACILITIES OF ENSELE
L. Entire Agreement. This Membership Agreement constitutes the entire agreement between us concerning its subject matter and supersedes all priIS or negotiations, understandings, representations and agreements. This Membership Agreement cannot be amended except by a written agreement executed by all parties.
I AM ENTITLED TO A COPY OF THIS CONTRACT AT THE TIME I SIGN IT. I MAY CANCEL THIS CONTRACT AT ANY TIME BEFORE MIDNIGHT OR THE THIRD BUSINESS DAY AFTER RECEIVING A COPY OF THIS CONTRACT. IF I CHOOSE TO CANCEL THIS CONTRACT, I MUST EMAIL A SIGNED AND DATED WRITTEN NOTICE OF CANCELLATION TO [email protected]
IF I CANCEL THIS CONTRACT WITHIN THE THREE-DAY PERIOD DESCRIBED ABOVE, I AM ENTITLED TO A FULL REFUND OF MY MONEY LESS A FEE EQUAL TO THE VALUE OF ANY PRODUCTS AND SERVICES RECEIVED. REFUNDS WILL BE MADE WITHIN 30 DAYS AFTER THE RECEIPT OF THE CANCELLATION NOTICE BY ENSELE.
THE TERM “BUSINESS DAY” MEANS MONDAY THROUGH FRIDAY, EXCLUDING LEGAL HOLIDAYS IN THE STATE WHERE THE ENSELE LOCATION WHERE I SIGNED THIS MEMBERSHIP AGREEMENT IS LOCATED.
